The main purpose of the family guidance committee is to make both parties understand their values and importance in both of their lives and try to reconcile them before their separation in Article 98 of the personal status law. Divorce in the UAE is defined as the annulment of the parties' legally binding marital contract. The husband or the woman can file for divorce if her spouse granted her the right to do so (Isma') in the marital contract. You can get a divorce in two ways, which are as follows:-
1. Pronouncing the word 'Talaq' (which means 'I divorce you' in Arabic). In the presence of a witness, the husband or wife (if she has 'Isma') must speak or write 'I divorce you' or 'Talaq.' This is a religiously acceptable manner of divorce for Muslims, but in order for the divorce to be legally recognised, it must be registered with the court.
This allows documentary evidence of the divorce to be used in court in the future. (Divorce is regarded as valid when...the judge authenticates it, according to Article 106 of the Personal Status Law.) If there is a disagreement over whether the Talaq was spoken, the witness can testify in court. There are financial ramifications for a spouse who starts a divorce without their spouse's agreement by pronouncing the Talaq.
2. The second approach to getting a divorce is to file a court petition (also known as "separation by judgment"). The applicant will file a divorce petition, and the parties will be referred to the court's Family Guidance Committee.
The Family Guidance Committee's mission is to try to bring the parties together before separating them under Article 98 of the Personal Status Law. The family guidance counsellors are not lawyers, but they have mediation and counselling experience. They meet with both parties and, if reconciliation is not possible, the case is referred to a court.
