A criminal action for cheque bounce must be filed within five (5) years after the date of receipt of the cheque, according to UAE rules and regulations. The Court of Cassation of Dubai strongly approved the ruling in Court of Cassation Case Number 207 of 2001, dated November 24, 2001, and Court of Cassation Case Number 177 of 2003, dated June 28, 2003.

 

It's also worth noting that, even when dealing with the same subject matter, the timelines for civil and financial matters differ. As a result, a criminal's timeline for a cheque bounce is two years from the date the payment was due. Federal Law Number 18 of 1993 on Commercial Transactions Law mentions this premise. Another important factor to consider when pursuing civil or criminal cheque bounce cases is that the time limit for a criminal case begins on the date the check was delivered to the beneficiary, whereas the time limit for a civil case begins on the date the cheque was due, which is 5 years for the former and 2 years for the latter.

 

Despite the foregoing, it is critical for those involved in such situations to remember that there are some exceptions to this general rule of law; however, it is recommended that such deviations be discussed with the country's learned counsel.
